Analysis of the case against Dr. Binyamin Rothstein by Judge Sander Goldberg

“….As mentioned, after a thorough review of his case, including reading the entire transcript of his hearing before an ALJ, all the briefs, exceptions and responses, I have concluded that the action of the Maryland Board of Physician’s (MBP) is an outrage by any stretch of the imagination.

 Dr. Binyamin Rothstein is a brilliant and extremely talented practitioner of medicine. He has a creative and innovative mind and is not afraid to utilize newly approved therapies, complementary and “alternative” therapies to augment conventional medical modalities of therapy if he is convinced that they are more efficacious.....He has a proven record of wonderful success in treating his patients using a combination of conventional, osteopathic and alternative therapies....In his entire career he has had thousands of patients who have been significantly helped by alternative therapies. He has also had patients that responded better to conventional treatment. But, as one who exhibits utmost concern for the welfare of his patients, to my knowledge, not one has actually been harmed by his use of non-conventional modalities...
  

The Board scrupulously nit picked and labored to find and interpret the most niggling violations, based upon disputable opinion in any case, in order to impose its most extreme sanction on Dr. Rothstein. Yet, nowhere did the Board care or bother, from the very same records they scrutinized, to evaluate the expediency and success rate of Dr Rothstein’s treatment of his patients’ ails. For had they done so, they would have found that his medical care, diagnosis and successful treatment rates with the top allopathic practitioners in the profession. ...But, Dr. Rothstein, upon whom it was never alleged that he harmed patients, nor was even a shred of evidence to this effect suggested, and who has an outstanding reputation for diagnosis and treatment, gets revoked……..

Dr. Binyamin Rothstein is an outstanding healer of human ailments. I venture to say that he stands head and shoulders above many of those on the board who have revoked his license..."
